This is the bit I like that Paypal will protect you was it not for a matter of the small print

Even though you may escalate an Item Not Received Dispute to a Claim, you are not guaranteed a recovery. If the Claim is decided in your favour, your recovery is limited to the amounts that PayPal can recover from the seller’s Account.

This does not sound like your ‘Fully protected’ to me if the seller has emptied the account and Paypal won’t put their hands in their own pockets to settle a legitimate claim.

PayPal retains full discretion to make a final decision in favour of the buyer or the seller based on any criteria PayPal deems appropriate. In the event that PayPal makes a final decision in favour of the buyer or seller, each party must comply with PayPal’s decision.

PayPal seems to suggest it can be Judge and Jury too but just because they hide this in a 20 page user agreement does not mean it will stand up in a court of law or override your rights as a consumer.

14.6 No Warranty. We provide the Services to you subject to your statutory rights but otherwise provided without any warranty or condition, express or implied, except as specifically stated in this Agreement.

Nice to see the ‘No Warranty’ bit but at lease we got our statutory rights back if only the trading standards and office of fair trading would do there jobs.

“Random Deposit Process” is a verification process whereby PayPal will send you two small deposits to your bank account. To complete the Random Deposit Process you will be required to enter the details of the deposits sent to you via your Account.

Just a word off warning is Paypal forget to say that if for any reason such as you spent the day reading Paypals user agreement and then decided not to continue with the contract then your inbox will be inundated with emails from Paypal telling you to complete the process and it’s no use replying as you are taking to a machine.

My question is is it legal to take money from someones account without their prior knowledge?. My money was refunded after a couple of months and Paypal account unfrozen. However I have not dared use this facility again or sell on ebay and after reading things here have closed down my account with Paypal. full story

Dont think this is a one off case or Sellers are safe

Then, in February, came the real deal breaker. PayPal refused to release deposits totaling over $20,000 even after Brody sent verification information proving that his customers used their own credit cards (rather than stolen ones) to secure PayPal acounts. At that point, Brody contacted the FBI and decided to sue, not just to recover the cash in his account, but also for $400,000 worth of lost business. "It's a poorly run company with low-grade standards," he says. "Let's face it: Banks don't make these kinds of mistakes." The bottom line is Paypal does not make buying safe and can create even more problems in the process and I believe PayPal is being fattened up by eBay and will be sold off but in the mean time the number of disgruntled customers will continue to rise.

check out Ebay and Paypal on the
Better Business Bureau and see all the complaints they have since
January. There are well over 10,000 of them. Ebay soon will be a
thing of the past and they will continue to lose thousands of members
a week to Amazon, just like me.

Thank you for your comment to me - really appreciate it. I read your ME page, what a terrible thing to have happened to you, I hope you win. eBay has become a place for scammers and it appears that eBay and Paypal are on their side!

I am still fighting yet another case, whereby somebody in the Chech Republic purchased an item in September, left positive feedback then put in a chargeback, Paypal refunded their money, and still awaiting outcome even though this was sent international signed for and they received it, but now saying credit card used without authorisation.

What a joke this is, but I cannot give it up as I am selling between £3000 - £4000 per month which is keeping me going in this present clime of depression as my B&M shop is not doing too well even after being in business over 50 years. Rant over.

Any suggestions from someone with alot more knowledge than I would be appreciated.
